The Mixed Ruling, Explained
Ark Restaurants has been locked in a legal battle with the Bryant Park Corporation since early 2025 over who gets to operate the Bryant Park Grill, Bryant Park Café, and The Porch at Bryant Park. The leases expired in spring 2025, and the landlord selected a different operator. Ark sued, arguing the bidding process was flawed and that it held a right of first lease on the Café.
On June 18, 2026, the court delivered a split decision. It granted summary judgment in Ark's favor on its breach-of-contract claim tied to the Bryant Park Grill lease and the right of first lease for the Café. That means Ark is entitled to money damages, with the amount to be determined at a future trial.
However, the court did not grant "specific performance," a remedy that would have forced the landlord to accept Ark's bid and let it stay. It also granted the landlord summary judgment on its claims for ejectment (eviction), use and occupancy payments, and breach of contract concerning the Café lease and the Porch license. The rest of Ark's claims, including an age discrimination allegation, were dismissed.
What Happens Next
Ark intends to appeal the parts of the ruling that went against it. Filing that notice of appeal triggers an automatic stay, meaning the company cannot be evicted while the appeal is pending. To keep that protection, Ark will need to post an undertaking, essentially a bond, in an amount the court will set to cover the likely duration of the appeal.
The company continues to operate all three venues and has been making the required use-and-occupancy payments throughout the dispute.
Why This Matters for Investors
The Bryant Park properties are significant to Ark's business. The company itself states that the uncertainty around this dispute has already had a material adverse impact and will continue to do so while litigation drags on. The mixed ruling keeps Ark in the venues for now, but the path to a permanent resolution remains unclear. If the appeal fails, Ark faces eviction and the loss of these locations. If it succeeds, the company could secure a better outcome, though the court has already ruled out forcing the landlord to accept Ark's bid. The upcoming trial will determine the actual dollar amount of damages Ark can collect, but that figure is unknown today.
